The legal configuration of the offense of stalking (Art. 612-bis c.p.)

The crime of stalking, introduced by article 612-bis of the Penal Code, punishes anyone who, through repeated conduct, threatens or harasses another in a way that causes a serious and irreversible prejudice to their existence. The Supreme Court's jurisprudence has ruled that, for punishability, the stalker's conduct must have caused, alternatively or cumulatively, at least one of the following three affirmed events:

  • A persistent and severe state of anxiety or fear: A profound alteration of the victim's emotional balance, resulting in a state of hypervigilance and psychological prostration.
  • A well‑founded fear for one's own safety or that of a close relative: The objective perception of an imminent danger to one's physical safety or that of persons bound by affective ties.
  • The alteration of one's daily habits: Material coercion to change one's daily routes, work schedules, telephone numbers, or social interaction methods to avoid encountering the perpetrator.

Tailing, stakeouts and field observation

We document the systematic presence of the stalker near the victim's home, workplace, or gathering points. Dynamic and static observation operations are carried out by professional investigators in a low‑profile mode, ensuring maximum confidentiality and collecting high‑definition video‑photographic recordings that attest to the illicit and repeated interference in the victim's vital spaces.

Cyberstalking and digital forensics

When harassment develops on electronic channels (social networks, instant‑messaging apps, emails sent under a false name or anonymous calls), our forensic IT department intervenes by extracting and analyzing logs, metadata, and messages. Every digital evidence is crystallized in compliance with the electronic chain of custody, preventing challenges of evidence alteration and, where possible, proceeding to identify the sender's IP address.

Through covert damage to premises, deliberately caused nuisance noises, or insults in common areas, condominium stalking requires the use of dedicated technological equipment that documents the illicit act while operating exclusively within the perimeter of public areas or the client’s exclusive property, excluding any risk of trespassing on third‑party dwellings.

From the police chief’s warning to precautionary measures

The evidential findings produced by Arcadia Company’s investigations provide the essential legal tool to activate the two main protection channels provided by the legal system:

First, they enable the activation of the administrative procedure of the Police Chief’s Warning (pursuant to art. 8 of D.L. n. 11/2009), a flexible preventive measure that formally orders the stalker to cease harassing conduct, whose violation triggers the offense’s ex officio prosecution with an increased penalty. Second, the evidential dossier provides the Public Prosecutor with the necessary elements to request the Judge to apply urgent coercive precautionary measures, such as the prohibition of approaching places frequented by the victim (Art. 282-ter c.p.p.) or, in the most serious cases, pre‑trial detention.

Electronic sweeps and defensive investigations: Where there is a well‑founded suspicion that the perpetrator monitors the victim’s location or communications in real time, Arcadia Company conducts environmental and electronic sweeps (TSCM) on vehicles, smartphones and residences, locating and neutralizing hidden GPS trackers, bugs or spyware. All activities are carried out under the regime of criminal defensive investigations pursuant to articolo 327-bis del Codice di Procedura Penale.
